color: rgb(51, 51, 51); font-size: 14px; text-indent: 2em; text-align: justify; line-height: 2em; font-family: 微软雅黑 !important;" align="justify"><span style="letter-spacing: 2px;">第八部分:结算方式。(一)选择货币补偿的,在征收人与被征收人签订协议后按照协议书约定期限结清补偿款。(二)选择平台购房安置的,征收人按照补偿协议先行支付80%补偿款,被征收人完成购房备案手续且经房产管理部门审核后,结清剩余20%的补偿款。(三)选择产权调换的,被征收房屋补偿款在签订征收补偿安置协议时用作交付安置房款,房屋补偿款小于安置房款的待安置房交房时一次性付清,未结清安置房款的不予办理交房手续。</span></p><p style="list-style: none; color: rgb(51, 51, 51); font-size: 14px; text-indent: 2em; text-align: justify; line-height: 2em; font-family: 微软雅黑 !important;" align="justify"><span style="letter-spacing: 2px;">(一)对征收范围内的房屋权属按照《中华人民共和国城市房地产管理法》、《不动产登记暂行条例实施细则》、《房产测量规范》等法律法规并结合我县2012年航测图进行确权。房屋的权属、区位、用途、建筑面积和年代等以合法有效证件载明的为准,合法有效证件载明不清的以现场勘测登记为准。</span></p><p style="list-style: none; color: rgb(51, 51, 51); font-size: 14px; text-indent: 2em; text-align: justify; line-height: 2em; font-family: 微软雅黑 !important;" align="justify"><span style="letter-spacing: 2px;">(二)被征收房屋属“房改房”,但个人产权为有限产权的,需按相关规定补齐至100%产权,否则仍按有限产权登记与补偿。</span></p><p style="list-style: none; color: rgb(51, 51, 51); font-size: 14px; text-indent: 2em; text-align: justify; line-height: 2em; font-family: 微软雅黑 !important;" align="justify"><span style="letter-spacing: 2px;">(三)设有抵押权的房屋,抵押权人从征收公告发布之日起应主动与县征安中心对接,并按照国家有关法律、法规处理相关事宜,否则,由此造成的责任由抵押权人自负。</span></p><p style="list-style: none; color: rgb(51, 51, 51); font-size: 14px; text-indent: 2em; text-align: justify; line-height: 2em; font-family: 微软雅黑 !important;" align="justify"><span style="letter-spacing: 2px;">(四)对权属有争议的房屋由县征安中心申请公证机关办理证据保全,待有关部门权属界定后补办确权手续。权属界定期间不影响房屋征收工作。已进入执法、司法程序的按有关规定处理。</span></p><p style="list-style: none; color: rgb(51, 51, 51); font-size: 14px; text-indent: 2em; text-align: justify; line-height: 2em; font-family: 微软雅黑 !important;" align="justify"><span style="letter-spacing: 2px;">(五)县征安中心应当根据被征收人提供的合法有效证照所确认的房屋面积和用途,对被征收人予以补偿。</span></p><p style="list-style: none; color: rgb(51, 51, 51); font-size: 14px; text-indent: 2em; text-align: justify; line-height: 2em; font-family: 微软雅黑 !important;" align="justify"><span style="letter-spacing: 2px;">被征收房屋的权属、面积、用途应当依据房屋所有权证和房屋登记簿确认,房屋所有权证和房屋登记簿不一致的,除有证据证明房屋登记簿确有错误外,以房屋登记簿的记载为准。</span></p><p style="list-style: none; color: rgb(51, 51, 51); font-size: 14px; text-indent: 2em; text-align: justify; line-height: 2em; font-family: 微软雅黑 !important;" align="justify"><span style="letter-spacing: 2px;">房屋所有权证、房屋登记簿所载内容与建设工程规划许可证不符的,以建设工程规划许可证所载内容为准。</span></p><p style="list-style: none; color: rgb(51, 51, 51); font-size: 14px; text-indent: 2em; text-align: justify; line-height: 2em; font-family: 微软雅黑 !important;" align="justify"><span style="letter-spacing: 2px;">(六)房屋无有效证照,但在2012年航测图上有标注且产权归属明晰的,可以结合2012年航测图确定房屋面积,并给予补偿;2012年航测图无标注但经政府组织有关部门对房屋合法性予以确认的,可以给予补偿;2012年航测图无标注且不能认定为合法建筑的,一律按照违法建筑处理,若征迁户在规定期限内搬迁的,可给予适当补助。</span></p><p style="list-style: none; color: rgb(51, 51, 51); font-size: 14px; text-indent: 2em; text-align: justify; line-height: 2em; font-family: 微软雅黑 !important;" align="justify"><span style="letter-spacing: 2px;">(二)选择平台购房安置的,征收人按照补偿协议先行支付80%补偿款,被征收人完成购房备案手续且经房产管理部门审核后,结清剩余20%的补偿款。</span></p><p style="list-style: none; color: rgb(51, 51, 51); font-size: 14px; text-indent: 2em; text-align: justify; line-height: 2em; font-family: 微软雅黑 !important;" align="justify"><span style="letter-spacing: 2px;">(三)选择产权调换的,被征收房屋补偿款在签订征收补偿安置协议时用作交付安置房款,房屋补偿款小于安置房款的待安置房交房时一次性付清,未结清安置房款的不予办理交房手续。房屋补偿款超过安置房款的,超出部分在腾空房屋经验收合格,签订征收补偿安置协议后按照协议书约定期限结清补偿款。</span></p><p style="list-style: none; color: rgb(51, 51, 51); font-size: 14px; text-indent: 2em; text-align: justify; line-height: 2em; font-family: 微软雅黑 !important;" align="justify"><span style="letter-spacing: 2px;">1、搬迁、签约奖:按被征收房屋合法建筑面积给予:①在前20天内(从2024年 月 日至2024年 月 日)搬迁、签约奖150元/㎡的奖励;在第21天至30天内(从2024年 月 日至2024年 月 日)搬迁、签约奖100元/㎡的奖励。②商业用房选择货币补偿的,奖励评估市场(均)价的10%。③征收企业厂房,在规定期限内搬迁的,县征安中心可以委托具有资产评估资质的评估机构对用于生产经营的机械设备(不含已废弃机械设备)现值进行评估,经现场公示无异议后,按照评估结果的10%对机械设备搬迁费用予以补偿。④选择育英嘉苑安置小区住宅用房并在规定的搬迁、签约期限内搬迁、签约的,给予其用于产权调换的被征收房屋面积10%奖励。</span></p><p style="list-style: none; color: rgb(51, 51, 51); font-size: 14px; text-indent: 2em; text-align: justify; line-height: 2em; font-family: 微软雅黑 !important;" align="justify"><span style="letter-spacing: 2px;">县征安中心负责国有土地上房屋征收与补偿;城关镇负责组织实施该片区房屋及附属物调查、登记工作;自然资源和规划局负责明确被征收人国有土地使用权取得方式、性质、用途和国有土地使用权的收回;规划中心牵头负责对被征收房屋合法性及用途的认定;城管执法局负责实施控违、拆违工作并使用规划中心提供的2012年航测图对被征收房屋进行现场比对;不动产登记中心负责被征收房屋及土地的权属调查;县纪委监委、财政、审计、公安、市场监管、供电、供水、供气等单位各司其职、各负其责。</span></p><p style="list-style: none; color: rgb(51, 51, 51); font-size: 14px; text-indent: 2em; text-align: justify; line-height: 2em; font-family: 微软雅黑 !important;" align="justify"><span style="letter-spacing: 2px;">2. 被征收房屋产权性质为住宅,现实际从事经营、生产等的房屋(住改非),依据国办发〔2003〕42号文件规定,按其合法产权房屋中实际从事经营的部分,一次性给予6个月的停产停业损失费补偿。</span></p><p style="list-style: none; color: rgb(51, 51, 51); font-size: 14px; text-indent: 2em; text-align: justify; line-height: 2em; font-family: 微软雅黑 !important;" align="justify"><span style="letter-spacing: 2px;">3. 被征收房屋的权属、结构、用途等依据有效权属证载或政府相关职能部门现场认定登记为准,并张榜公布。经认定为违法建筑或超过批准期限的临时建筑不予补偿。若被征收人在本方案确定签约期内签约交房的,对其违法建筑按结构给予一定金额的材料补助(混合300元/㎡,砖木220元/㎡,其他100元/㎡);进入执法、司法程序的一律不予补助。</span></p><p style="list-style: none; color: rgb(51, 51, 51); font-size: 14px; text-indent: 2em; text-align: justify; line-height: 2em; font-family: 微软雅黑 !important;" align="justify"><span style="letter-spacing: 2px;">4. 被征收人选择房屋产权调换且被征收全部住宅房屋面积不足50㎡,按50㎡计算临时安置费。</span></p><p style="list-style: none; color: rgb(51, 51, 51); font-size: 14px; text-indent: 2em; text-align: justify; line-height: 2em; font-family: 微软雅黑 !important;" align="justify"><span style="letter-spacing: 2px;">5. 县征安中心与被征收人在本方案规定的签约期限内达不成补偿协议的,或者被征收房屋所有权人不明确的,由县征安中心报请霍邱县人民政府依照本方案作出补偿决定并在征收范围内公告。被征收人在法定期限内不申请行政复议或不提起行政诉讼且在补偿决定规定的搬迁期限内又不搬迁的,由县人民政府依法申请人民法院裁定强制执行。</span></p><p style="list-style: none;
